The Resort went into foreclosure, Not Bankruptcy in 2000. The most interesting part is that the outdoor pool at the Lakeview hotel was specifically exempted from the foreclose collateral. Why? We believe it is a shared asset that belongs to the property owners of Shanty Creek on equal footing with the hotel. See Liber 506 p690 Schedule A -#6 in the mortgage docs.
